Welcome to YOLO Adventures. These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1Acceptance of Terms

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legal agreement between you and YOLO Adventures.

2Changes to Terms

We reserve the right to modify these Terms at any time. All changes are effective immediately when posted and apply to all access to and use of the Services thereafter. Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes.

3User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

We reserve the right to disable any user account at any time if, in our opinion, you have violated any provision of these Terms.

4Booking and Reservations

When you make a booking through our Services, you acknowledge and agree to the following:

• ✓You are at least 18 years of age or have the legal authority to enter into this agreement
• ✓You have the legal capacity to make the booking
• ✓All information you provide during the booking process is accurate and complete
• ✓You accept responsibility for all persons included in your booking
• ✓You have read and agree to our specific booking terms, cancellation policies, and payment schedules

5Payments and Fees

When you make a booking, you agree to pay all fees associated with the booking, including:

• ✓The booking deposit (typically 30% of the total trip cost, non-refundable)
• ✓The remaining balance by the specified due date (typically 60 days before departure)
• ✓Any applicable taxes, surcharges, or fees disclosed during the booking process

All payments must be made in the currency specified during the booking process. Prices are subject to change until your booking is confirmed with payment.

6Cancellation and Refund Policy

All cancellation requests must be made in writing to bookings@yoloadventures.com.

We strongly recommend purchasing travel insurance to protect against unforeseen circumstances that may require you to cancel your trip.

7Trip Changes and Cancellations by YOLO Adventures

We reserve the right to modify or cancel any trip, itinerary, or activity due to circumstances beyond our control, including but not limited to natural disasters, political unrest, terrorism, health concerns, or insufficient participation.

In the event of a trip cancellation by YOLO Adventures:

• ✓We will offer you the option to transfer to another trip or receive a full refund
• ✓We are not responsible for any incidental expenses or consequential losses that you may have incurred as a result of the booking, such as visas, vaccinations, non-refundable flights, or loss of enjoyment

8Travel Documentation and Requirements

You are responsible for obtaining and maintaining all necessary travel documents, including passports, visas, permits, and health certificates. Your passport must be valid for at least six months beyond the duration of your trip. We are not responsible for any issues arising from inadequate travel documentation.

9Health and Fitness

Our adventures require varying levels of fitness and physical ability. You represent that you and all members of your party:

• ✓Are in good physical and mental health
• ✓Have disclosed any medical conditions, allergies, or dietary restrictions that may affect your participation
• ✓Meet the specified fitness requirements for your chosen adventure
• ✓Have consulted with a physician if you have any concerns about your ability to participate

We reserve the right to refuse participation or remove any person from an activity if we believe their participation poses a safety risk to themselves or others.

10Assumption of Risk and Release of Liability

You acknowledge that adventure travel involves inherent risks and dangers, including but not limited to:

• ✓Physical exertion and potential injury
• ✓Exposure to extreme conditions and environments
• ✓Transportation accidents
• ✓Political instability, terrorism, or criminal activity
• ✓Health hazards and disease
• ✓Natural disasters

By booking with us, you voluntarily assume all risks and dangers associated with your participation in our adventures. To the maximum extent permitted by law, you agree to release, waive, and hold harmless YOLO Adventures and its officers, employees, agents, and partners from any and all claims, liabilities, damages, or losses arising from your participation in our adventures.

11Limitation of Liability

To the maximum extent permitted by law, YOLO Adventures shall not be liable for:

• ✓Any indirect, consequential, special, incidental, or punitive damages
• ✓Any loss, damage, or injury to persons or property
• ✓Any loss due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof
• ✓Acts of God, strikes, weather, quarantines, or other causes beyond our control

Our liability for any damages whatsoever shall not exceed the amount paid by you for the specific trip or service that gave rise to the claim.

12Image and Likeness

You grant YOLO Adventures permission to capture and use your image, likeness, and voice in photographs, videos, and recordings taken during your adventure for promotional, commercial, and marketing purposes without compensation or further notice.

13Intellectual Property

All content on our Services, including text, graphics, logos, images, and software, is the property of YOLO Adventures or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or republish any content from our Services without our prior written consent.

14User Content

By submitting content to our Services (including reviews, photos, videos, or testimonials), you grant YOLO Adventures a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that you own or control all rights to the content you submit and that the content does not violate these Terms or infringe upon the rights of any third party.

15Prohibited Activities

You agree not to:

• ✓Use our Services for any unlawful purpose or in violation of these Terms
• ✓Use our Services in any manner that could disable, overburden, damage, or impair the site
• ✓Use any robot, spider, or other automatic device to access our Services
• ✓Introduce any viruses, Trojan horses, worms, or other harmful material
• ✓Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of our Services
• ✓Use our Services to transmit or send unsolicited or unauthorized advertising or promotional materials

16Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or related to these Terms or our Services shall be subject to the exclusive jurisdiction of the courts in Gurugram, Haryana, India.

17Dispute Resolution

In the event of any dispute between you and YOLO Adventures, we agree to first attempt to resolve the dispute informally. If we are unable to resolve the dispute informally, the dispute shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India.

18Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

19Entire Agreement

These Terms, together with our Privacy Policy and any other agreements or policies referenced herein, constitute the entire agreement between you and YOLO Adventures regarding your use of our Services.
